With your purchase of Quark software, you recognize that an excellent team of product managers, salespeople, software developers, warehouse technicians, and many other contributors combined their efforts to deliver technology on which you can rely. For your patronage, Quark is committed to offering you superior customer service and technical support, as well as software updates and upgrades — a long-term investment in your continued success.

Unfortunately, some customers are duped into buying pirated software through auction Web sites, fraudulent retailers, and other sources. While the temptation to purchase low-cost software may be strong, there are many reasons to do business only with reputable sources. In addition to the legal issues of using copied or counterfeit software, your pirated purchase:

  • Cannot be installed due to an incorrect or fraudulent validation code or serial number
  • Lacks the technical support and assistance granted to properly licensed users
  • May increase your exposure to viruses through corrupted disks or flawed media
  • Is ineligible for upgrades available only to licensed users

When you purchase a music CD or a movie DVD, you do not become the owner of that music’s or film’s copyright. The same is true when you purchase software. What you purchase is the right to use the software under the guidelines defined by the copyright owner. This copyright protection is critical to preserve the ongoing investment in research, development, and support of the software products on which you rely, as well as protecting the jobs of the myriad people involved in the creation of the software.

To ensure your Quark products are legitimate, please purchase your software through our online store, or through a recognized Quark retailer, some of which are listed on www.quark.com/resellers

1. What is software piracy?
Buying software does not mean that you own the software application. Instead, you are a licensed user. That means you purchase the right to use the software, but you can't use copies on several computers or share software with colleagues. Software piracy is the illegal distribution and/or reproduction of software applications for business or personal use. Whether software piracy is deliberate or not, it is still illegal and punishable by law.

There are many forms of piracy:

  • Licensed user duplication for unlicensed users: Copying software without buying the appropriate number of licenses is copyright infringement.
  • Illegal distribution through the Internet: Be careful when ordering software through the Internet. Many resellers with Internet stores or those who sell from an auction site sell copies of software illegally. So, if the pricing seems too good to be true, be cautious.
  • Distributing education licenses to unauthorized markets: Quark provides special education licenses and license packages of its software to meet the needs of the education market. Duplication of these specialized versions for distribution to other markets is prohibited. To find out who qualifies for educational pricing, visit www.quark.com/education/

To ensure your Quark products are legitimate, please purchase your software through our store, or through an authorized Quark reseller, some of whom are listed on www.quark.com/resellers/.

2. Who benefits from copyright law?
Everyone benefits from copyright law. Because it protects the investment of computer software companies, copyright law encourages software companies to invest in the development of new, creative, and innovative products. These companies spend large portions of their earnings on the development of new products and need to receive a fair return on their investment if they are to continue the cycle. Without the protection given by copyright laws, software companies would be unable to produce the valuable programs that have become so important to our daily lives. Avoiding software piracy also means avoiding distortion of competition. Freelancers and companies should have the same competitive conditions regarding software purchase. In order to support the fight against software piracy Quark is an EMEA Anti-Piracy member of the Business Software Alliance (BSA).

3. How do I benefit from purchasing my own Quark software?
When you purchase authorized copies of QuarkXPress, you receive, for example:

  • A printed handbook/manual
  • Training videos from lynda.com
  • Free updates that provide enhanced performance, additional language support, or additional features
  • Added-value items such as Quark XPert Tools Pro, a collection of powerful XTensions software
  • The opportunity to purchase upgrades
  • Free technical support in German, English, and French
  • Using authorized and authentic Quark software, ensures that the software is safe and stable

4. What are the risks of buying or using pirated software?
If you buy or use pirated software:

  • You may not be able to install the software due to an incorrect or fraudulent validation code or serial number
  • You will not receive the technical support and assistance, such as user guides, technical documentation, training, etc., granted to properly licensed users
  • You may increase your exposure to viruses through corrupted disks or flawed media
  • You will be ineligible for upgrades that are available only to licensed users
  • You have no warranty to protect your investment
  • You may be subject to significant fines for copyright infringement
  • As a company, you risk damage to your reputation and, in the case of organizations, negative publicity that could cause irreparable harm

5. What is a license agreement?
Generally, each and every piece of software used on your company’s computers should be covered by a license agreement. Unless the license states otherwise, you may only use one software license on one computer. Some software companies offer bulk licensing agreements, which may be more cost effective than purchasing individual licenses. Quark allows you to use QuarkXPress on two computers, for example at home and at work, regardless if it is used on Mac OS or Windows.

6. Can I install QuarkXPress at work and at home on two different computers?
QuarkXPress users can activate one license on two different computers and on two different platforms (for example, a Windows computer at home and a Mac OS computer at work) at no additional cost. The license agreements of other software companies may be different from Quark’s. As with QuarkXPress, some licenses permit the installation of two copies — usually with the stipulation that each copy is used by the same person and that the two copies will not be used simultaneously.

7. Can I run previous versions of QuarkXPress on my computer and have QuarkXPress 7 installed?
Yes, Quark users who own a license and who are upgrading from version 4 or 5 to QuarkXPress 7 can continue to run previous versions of the software while using QuarkXPress 7, although technical support is only offered for QuarkXPress 6 and later.

8. Can I purchase a single software license and use it on several computers?
No, this is known as "softlifting" and is not allowed according to the terms of most license agreements. You are not allowed to share software with other users. The only time that you can use one QuarkXPress license on two computers is when you are the only person using the software. You are not permitted to install QuarkXPress on two computers used by different users or on more than two computers.

9. What if I want to use my software on several computers?
If you wish to use the software on several computers, you must purchase several individual licenses, a multiple-user license, or purchase under a volume license plan. Quark offers a Volume Licensing Programme for QuarkXPress licenses that is available across the Americas either through Quark resellers or from Quark customer service. Volume discounts mean lower price points for new licenses and upgrades compared with the costs of purchasing multiple individual licenses. For further information on this programme, go to www.quark.com/products/xpress/purchase/multi_user.html.

10. Can I legally copy my friends' software?
No, software is protected by federal copyright law, which says that you can't make additional copies of software without the permission of the software developer.

11. What is counterfeit software? How can I tell if software is counterfeit?
Counterfeit software is hard-copy software that has been reproduced by someone other than an authorized distributor. It may look just like the original software, but it is often quite easy to identify as counterfeit. If you are offered extremely inexpensive software, look for some of the following warning signs that you might be buying or receiving pirated products:

  • The software lacks proper documentation
  • The manual is either photocopied or missing
  • The software does not look authentic. For example, the software, product packaging, or accompanying materials are of inferior quality or include handwritten labels
  • The serial number/CD key is printed on the CD-ROM, sleeve, or jewel case
  • One CD-ROM contains multiple applications (be especially wary if the applications are from different companies)
  • The price of the software is far below retail price

12. How do I verify ownership of software purchased through the Internet?
We strongly advise you to maintain up-to-date records of your purchase invoices and receipts. E-mail correspondence detailing the purchase together with any receipts and official documentation from the developer (such as a license agreement) will enable you to verify software ownership.

13. Are invoices sufficient proof of ownership?
No, you must have the licenses because you must use the software in accordance with the terms of the End User License Agreement (EULA).

14. What is the legal consequence of copyright infringement?
Using computer software without a license is against the law and can result in a company having to pay significant sums in compensation, costs, and license fees. The seriousness with which the law treats such actions is emphasized by the fact that, in certain cases, using computer software without a license is punishable in the criminal courts by a large fine or even imprisonment. 15. What is the Business Software Alliance (BSA)?
The Business Software Alliance (BSA) is the foremost organization dedicated to promoting a safe and legal digital world. The BSA is the voice of the world's commercial software industry with governments and in the international marketplace. Its members represent one of the fastest growing industries in the world. BSA educates consumers about software management and copyright protection, cyber security, trade, e-commerce, and other Internet-related issues. Established in 1988, the BSA has programmes in more than 80 countries worldwide. Leading IT organizations and major software companies, such as Quark, are members of the BSA. To see who is a member of the BSA, visit http://www.bsa.org/uk/about/BSA-Members.cfm. The BSA is not a regulatory body; however, BSA is authorized by its members to act on their behalf if it has reason to believe that an organization is misusing software. BSA’s primary aim is to promote the value of software compliance within such organizations so as to make such investigations unnecessary.

16. How does BSA help prevent software piracy?
Authorized law firms act in the name of BSA and its member companies to investigate reports of suspected unlicensed use of BSA-member software. If BSA receives information from individuals reporting a company for using software illegally, BSA lawyers have complete discretion and control over whether to investigate or take action on information provided.

17. How can I investigate my software status or find help?
Organizations that voluntarily come to the BSA for guidance on software compliance can take advantage of support to help them to carry out effective software management. If you are not confident that you have a license for each piece of software used within your organization, we recommend that you perform a software audit to assess current software usage. You must make sure that for each copy in use you possess the relevant license. If you are in doubt as to exactly what you are covered for under a bulk or annual licensing plan, you should contact the relevant software developer(s).

18. How can I report piracy to the BSA?
You can call the BSA Hotline at 0870 3500 272 during office hours or supply the relevant information on the BSA Web site, http://www.bsa.org/uk/report/. BSA never divulges the identity of anyone that contacts BSA about any third parties (including BSA members) when using the information supplied to BSA; see http://www.bsa.org/usa/popup/Privacy-Policy.cfm.
