1. What is software piracy?
Buying software does not mean that you own the software application. Instead, you are a licensed user. That means you purchase the right to use the software, but you can't use copies on several computers or share software with colleagues. Software piracy is the illegal distribution and/or reproduction of software applications for business or personal use. Whether software piracy is deliberate or not, it is still illegal and punishable by law.

There are many forms of piracy:

• Licensed user duplication for unlicensed users: Copying software without buying the appropriate number of licenses is copyright infringement.
• Illegal distribution through the Internet: Be careful when ordering software through the Internet. Many resellers with Internet stores or those who sell from an auction site sell copies of software illegally. So, if the pricing seems too good to be true, be cautious.
• Distributing education licenses to unauthorized markets: Quark provides special education licenses and license packages of its software to meet the needs of the education market. Everyone benefits from copyright law. Because it protects the investment of computer software companies, copyright law encourages software companies to invest in the development of new, creative, and innovative products. These companies spend large portions of their earnings on the development of new products and need to receive a fair return on their investment if they are to continue the cycle. Without the protection given by copyright laws, software companies would be unable to produce the valuable programs that have become so important to our daily lives. Avoiding software piracy also means avoiding distortion of competition. Freelancers and companies should have the same competitive conditions regarding software purchase. 5. What is a license agreement?
Generally, each and every piece of software used on your company’s computers should be covered by a license agreement. Unless the license states otherwise, you may only use one software license on one computer. Some software companies offer bulk licensing agreements, which may be more cost effective than purchasing individual licenses. Quark allows you to use QuarkXPress on two computers, for example at home and at work, regardless if it is used on Mac OS or Windows.

6. Can I install QuarkXPress at work and at home on two different computers?
QuarkXPress users can activate one license on two different computers and on two different platforms (for example, a Windows computer at home and a Mac OS computer at work) at no additional cost. The license agreements of other software companies may be different from Quark’s. As with QuarkXPress, some licenses permit the installation of two copies — usually with the stipulation that each copy is used by the same person and that the two copies will not be used simultaneously.

7. Can I run previous versions of QuarkXPress on my computer and have QuarkXPress 7 installed?
Yes, Quark users who own a license and who are upgrading from version 4 or 5 to QuarkXPress 7 can continue to run previous versions of the software while using QuarkXPress 7, although technical support is only offered for QuarkXPress 6 and later.

8. Can I purchase a single software license and use it on several computers?
No, this is known as "softlifting" and is not allowed according to the terms of most license agreements. You are not allowed to share software with other users. The only time that you can use one QuarkXPress license on two computers is when you are the only person using the software. You are not permitted to install QuarkXPress on two computers used by different users or on more than two computers.

9. What if I want to use my software on several computers?
If you wish to use the software on several computers, you must purchase several individual licenses, a multiple-user license, or purchase under a volume license plan. Quark offers a Volume Licensing Programme for QuarkXPress licenses that is available across the Americas either through Quark resellers or from Quark customer service. Volume discounts mean lower price points for new licenses and upgrades compared with the costs of purchasing multiple individual licenses. 10. Can I legally copy my friends' software?
No, software is protected by federal copyright law, which says that you can't make additional copies of software without the permission of the software developer.

11. What is counterfeit software? How can I tell if software is counterfeit?
Counterfeit software is hard-copy software that has been reproduced by someone other than an authorized distributor. It may look just like the original software, but it is often quite easy to identify as counterfeit. If you are offered extremely inexpensive software, look for some of the following warning signs that you might be buying or receiving pirated products:

• The software lacks proper documentation
• The manual is either photocopied or missing
• The software does not look authentic. For example, the software, product packaging, or accompanying materials are of inferior quality or include handwritten labels
• The serial number/CD key is printed on the CD-ROM, sleeve, or jewel case
• One CD-ROM contains multiple applications (be especially wary if the applications are from different companies)
• The price of the software is far below retail price

12. How do I verify ownership of software purchased through the Internet?
We strongly advise you to maintain up-to-date records of your purchase invoices and receipts. E-mail correspondence detailing the purchase together with any receipts and official documentation from the developer (such as a license agreement) will enable you to verify software ownership.

13. Are invoices sufficient proof of ownership?
No, you must have the licenses because you must use the software in accordance with the terms of the End User License Agreement (EULA).

14. What is the legal consequence of copyright infringement?
Using computer software without a license is against the law and can result in a company having to pay significant sums in compensation, costs, and license fees.
